By downloading, installing, accessing, or using the Saturdays application ("the App," "Saturdays," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not download, install, or use the App.
These Terms constitute a legally binding agreement between you and Kendall Dale, sole proprietor ("Developer"). Please read them carefully.
Saturdays is a mortality-awareness and personal-wellness application. The App lets you estimate the number of Saturdays remaining in your life based on publicly available actuarial life-expectancy data, adjusted by self-reported health and lifestyle factors. The App also provides daily health-habit tracking features and optional family relationship visualizations.
THE APP DOES NOT PROVIDE MEDICAL ADVICE. The information, estimates, and content provided by Saturdays are for general informational, educational, and personal-reflection purposes only. Nothing in the App is intended to constitute, nor should it be construed as, professional medical advice, diagnosis, prognosis, or treatment.
The life-expectancy calculations in Saturdays are based on publicly available actuarial life tables, primarily sourced from U.S. government agencies (such as the Social Security Administration and the Centers for Disease Control and Prevention). These calculations:
The health and lifestyle adjustments used in the App's calculations (such as adjustments for smoking, exercise, BMI, alcohol consumption, and sleep) are based on general population-level research and publicly available health data. They are approximations and simplifications of complex health science, do not reflect the nuanced impact of these factors on any specific person, are not a substitute for professional medical evaluation, and should be understood as educational tools for general wellness awareness — not clinical assessments.
Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition, health concern, or lifestyle change. Never disregard professional medical advice or delay seeking it because of something you have seen or calculated in this App.

Saturdays deals directly with themes of mortality, aging, the passage of time, and the finite nature of life. This content is intended to promote mindful living and wellness awareness but may evoke strong emotional responses, including sadness, anxiety, existential distress, or grief.
By using the App, you acknowledge that you understand the nature of the App's content and voluntarily choose to engage with it. To the fullest extent permitted by applicable law, the Developer shall not be liable for any emotional distress, psychological discomfort, anxiety, grief, or other mental or emotional harm that may arise from using the App, viewing life-expectancy estimates, or engaging with mortality-related content.

The App is not a crisis-intervention tool and is not designed to provide mental-health support.
You must be at least 13 years of age to use Saturdays. By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed these Terms and consents to your use of the App.
If you are a parent or guardian allowing a minor between 13 and 17 to use the App, you agree to these Terms on behalf of that minor and accept responsibility for their use of the App. You acknowledge the App's mortality-related content and confirm that you believe it is appropriate for your child.
All data you enter into the App is stored locally on your device. You are solely responsible for the accuracy, completeness, and appropriateness of any data you enter.
The App allows you to enter limited information about family members (such as names, dates of birth, biological sex, and relationship to you). By entering information about other people, you represent and warrant that:
The Developer is not responsible for any disputes, claims, or harm arising from your entry of another person's information into the App.
If you use the App's sharing features to share content that includes information about or derived from a family member's data (such as a reveal image), you are solely responsible for obtaining any necessary consent before sharing and for any consequences of that sharing.
The App may allow you to generate and share a visual image (a "reveal image") that may include your estimated number of remaining Saturdays or other personalized content. When you share this image, you are doing so through your device's native share functionality. The Developer has no control over, and assumes no responsibility for, how shared content is received, used, or distributed by third parties once you share it. You acknowledge that sharing mortality-related estimates with others may be sensitive and should be done thoughtfully.
The Developer does not endorse, review, or monitor content shared by users. Sharing a reveal image does not constitute an endorsement by the Developer of the accuracy, appropriateness, or suitability of that content.
All intellectual property rights in and to the App — including its design, code, graphics, user interface, text, trademarks, logos, and the "Saturdays" brand — are owned by or licensed to the Developer. These Terms do not grant you any ownership interest in the App.
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device for your personal, non-commercial use.
You may not copy, modify, distribute, sell, lease, sublicense, reverse-engineer, decompile, or disassemble any part of the App; use the App for any commercial purpose without prior written consent; remove, alter, or obscure any proprietary notices, labels, or marks; use the App in any way that violates applicable law or these Terms; or create derivative works based on the App.
You retain ownership of the personal data and information you enter into the App. By using the App, you do not grant the Developer any rights to your personal data, except as necessary to provide the App's functionality on your device.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT THE LIFE-EXPECTANCY ESTIMATES, HEALTH ADJUSTMENTS, OR ANY OTHER CALCULATIONS OR INFORMATION PROVIDED BY THE APP ARE ACCURATE, COMPLETE, CURRENT, OR RELIABLE. ACTUARIAL DATA IS BASED ON HISTORICAL POPULATION STATISTICS AND MAY NOT REFLECT CURRENT OR FUTURE CONDITIONS. YOU ACKNOWLEDGE THAT ALL ESTIMATES ARE APPROXIMATIONS AND SHOULD NOT BE RELIED UPON FOR ANY DECISION-MAKING.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP; ANY ESTIMATES, CALCULATIONS, OR INFORMATION PROVIDED BY THE APP; ANY EMOTIONAL DISTRESS, ANXIETY, GRIEF, OR OTHER MENTAL OR EMOTIONAL IMPACT ARISING FROM THE APP'S CONTENT; ANY DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE APP; ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DEVICE OR DATA; OR ANY OTHER MATTER RELATING TO THE APP.
TO THE EXTENT THE FOREGOING LIMITATION IS NOT PERMITTED BY APPLICABLE LAW, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO DOWNLOAD THE APP, OR TEN DOLLARS ($10.00 USD), WHICHEVER IS GREATER.
YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND THE DEVELOPER AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND THE DEVELOPER.
You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App; your violation of these Terms; your entry of another person's information into the App without their consent; your sharing of App-generated content, including reveal images; or your violation of any applicable law or regulation.
You may terminate your use of the App at any time by uninstalling it from your device.
We reserve the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice.
Upon termination, your license to use the App ceases immediately. Sections 3, 4, 8, 9, 10, 12, 13, and 14 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith informal negotiation. If informal negotiation is unsuccessful, any remaining disputes shall be resolved exclusively in the state or federal courts located in Duval County, Florida, and you consent to the personal jurisdiction and venue of such courts.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIMS ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION AROSE. OTHERWISE, SUCH CLAIM IS PERMANENTLY BARRED.
You acknowledge and agree that these Terms are between you and the Developer only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. The Developer, not Apple, is solely responsible for the App and its content, any maintenance and support, any product warranties (to the extent not disclaimed), any product-liability claims, and compliance with applicable legal and regulatory requirements.
In the event of any third-party claim that the App infringes a third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements and understandings.
If any provision of these Terms is held unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed, and the remaining provisions shall continue in full force and effect.
The failure of the Developer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or any rights or obligations under them without the Developer's prior written consent. The Developer may freely assign these Terms.

Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the App and uninstall it.
